2020: Find a Name You Can Trust in CBD

February 16, 2020

In December of 2018, the United States Congress passed the Agriculture Improvement Act of 2018, also known as the Farm Bill. With its passage, the Farm Bill effectively removed hemp from the Federal Controlled Substances Act and legalized the cultivation of hemp as an agricultural commodity similar to grain and dairy.

With the passing of the Farm Bill, the market has witnessed a nearly instantaneous proliferation of hemp-derived products raiding the marketplace, most of which focus their sights on Cannabidiol, better known to the general public as CBD.

This domino effect in the market has left the federal government, and specifically the FDA, in a very tough position having to regulate an industry that is pumping out products faster than they can provide guidelines.

What is left for the consumer? An unregulated marketplace where vendors are incentivized to make a quick buck by over-promising and under-delivering on the contents and effectiveness of their products. Without FDA oversight in place, it is nearly impossible to know whether the contents of any one product actually reflects what is being marketed.

This issue has become exponential, so much so that the House Committee on Energy and Commerce recently convened to determine what it would take for federal agencies, such as the FDA and DEA, to catch up with the rapidly evolving cannabis marketplace. In particular, as it relates to CBD products as they do not contain any schedule 1 controlled substances (thanks to the Farm Bill).

The take away from that hearing was that more research and guidelines would need to be enacted before the FDA could ever hope to take a firm regulatory grip on the industry. Douglas Throckmorton, M.D., Deputy Directory for Regulatory Programs at the FDA estimated that it could take 3-5 years for that process to reach completion.3-5 years!

Therefore, it appears that the CBD products stampeding today’s marketplace will certainly continue to go largely unregulated.
